Alabama governor says ‘it’s time to start blaming the unvaccinated folks’ as pandemic worsens

210723-kay-ivey-ap-773.jpg

Alabama Gov. Kay Ivey issued an impassioned plea for residents of her state to get vaccinated against Covid-19, arguing it was “time to start blaming the unvaccinated folks” for the disease’s continued spread.

“I want folks to get vaccinated. That’s the cure. That prevents everything,” Ivey, a Republican, told reporters in Birmingham, Ala., on Thursday.

“Why would we want to mess around with just temporary stuff?” she said. “We don’t need to encourage people to just go halfway with curing this disease. Let’s get it done. And we know what it takes to get it done.”

Ivey went on to describe the shots as “safe” and “effective,” saying: “The data proves that it works. [It] doesn’t cost you anything. It saves lives.”

But the remarks from the governor grew more pointed when she was pressed on what it would take to get greater numbers of Alabamans vaccinated.

“I don’t know. You tell me,” Ivey said. “Folks [are] supposed to have common sense. But it’s time to start blaming the unvaccinated folks, not the regular folks. It’s the unvaccinated folks that are letting us down.”

Alabama remains the state with perhaps the lowest vaccination rate in the country, according to the CDC: Only 39.6 percent of its residents 12 and older have been fully vaccinated, compared to the 48.8 percent of Americans nationally who have received their shots.

On Thursday, Ivey told reporters she had “done all I know how to do” to boost her state’s vaccination numbers.

“I can encourage you to do something,” she said, “but I can’t make you take care of yourself.”

Alabama woman convicted on federal anti-riot charge

gettyimages-1242806165-c.jpg

An Alabama woman was found guilty on a federal civil disorder charge Wednesday following what appeared to be the first federal court trial of a participant in last year’s racial justice protests.

After several hours of deliberations, a jury in Mobile convicted Tia Pugh, 22, of the felony charge for smashing a local police cruiser’s window with a bat during a demonstration held just six days after the death of George Floyd in the custody of Minneapolis police sparked nationwide outrage.

“We’re very disappointed and even dismayed by the verdict and think it’s contrary to the evidence,” Pugh’s defense attorney, Gordon Armstrong, said in an interview. “Evidently, the jury saw it differently and we have to accept that.”

The case was one of dozens filed by the Justice Department under Attorney General Bill Barr after President Donald Trump called for an aggressive federal law enforcement response to unrest stemming from Floyd’s death.

In recent months, under the new Biden administration, Pugh’s case attracted the attention of officials at Justice Department headquarters because of a broad challenge she brought to the half-century-old statute.

Lawyers for Pugh, in cooperation with attorneys across the country defending against similar charges arising from last year’s unrest, argued that the 1968 law — formally called the “Civil Obedience Act” — has racist roots. The defense lawyers also pointed to other alleged flaws, such as the potential impact on First Amendment-protected activity like lawful demonstrations. They also said the measure lacks a sufficient connection to federal authority over interstate commerce.

Prosecutors, including one dispatched from Washington, defended the statute. They also noted that while it was not commonly used in recent decades, it is now being used to prosecute scores of suspects in the storming of the U.S. Capitol on Jan. 6.

U.S. District Court Judge Terry Moorer ruled the law was a valid exercise of congressional power, and he declined to wade into the complex history of the measure, which was passed as part of the broader Civil Rights Act of 1968.

Pugh faces up to five years in prison on the charge, although she will likely be sentenced according to federal guidelines that typically call for far less than the maximum.

Last week, defense lawyers for Pugh — who is Black — asked for a delay in the trial because of the small number of minorities in the roster of jurors assembled for the case. However, Moorer — Trump’s first Black appointee to the federal bench — allowed the trial to go forward.

The jury that was selected consisted of 10 white people and 2 Black people, Armstrong said.

Moorer set sentencing for Aug. 19, but said Pugh can remain free on bond until that date. Prosecutors asked that she be placed back on GPS tracking, but the judge declined.

Pugh still faces two state court charges related to her conduct at the same demonstration last May: inciting a riot and criminal mischief.

Shelby announces retirement, opening Senate seat in Alabama

gettyimages-1228687418.jpg

Sen. Richard Shelby (R-Ala.) announced Monday that he won’t seek reelection to a seventh term after more than four decades in Congress.

Shelby, who chaired the Senate Appropriations Committee until Democrats won control of the chamber last month, has long been seen as likely to retire in 2022. The 86-year-old Republican is the fourth most senior member of the upper chamber and the longest-serving senator from Alabama. He has chaired several committees over the course of his career, including the powerful Appropriations Committee, where he’s still the top Republican, and the Banking Committee, of which he’s the longest-serving member.

“Serving in the U.S. Senate has been the opportunity of a lifetime,” Shelby said in a statement. “I have done my best to address challenges and find ways to improve the day-to-day lives of all Americans.“

The Alabama Republican — known for his folksy demeanor and proclivity for meandering conversations with reporters in the hallways of the Capitol building — has helped steer billions of dollars in resources to his home state, including more than $1 billion for a new FBI headquarters and a U.S. Space Command headquarters in Huntsville, in addition to billions of dollars for the state’s ports and harbors.

In a statement, Shelby said he has “focused on the economic challenges of Alabamians, increasing access to education and promoting facilities to improve the quality of schools. I have worked to enhance Alabama’s role in space exploration and the security of our nation. Further, I have supported the utilization of Alabama’s greatest resources, including its unparalleled river system and the Port of Mobile.“

First elected in 1986 as a Democrat, Shelby became a Republican immediately following the GOP’s sweep in the 1994 midterm elections. His retirement will open a Senate seat in a safely Republican state where now-GOP Sen. Tommy Tuberville just ousted a Democratic incumbent, Doug Jones, by more than 20 percentage points last November.

Rep. Mo Brooks, who lost in the primary in the 2017 special election, is considered likely to run again. Other potential candidates include Katie Boyd Britt, a former chief of staff to Shelby who leads the business lobby in the state, Secretary of State John Merrill, who dropped out of the 2020 race, and Rep. Gary Palmer, who contemplated running last cycle but passed.

Another possible hopeful is Lynda Blanchard, a business executive and President Donald Trump’s former ambassador to Slovenia.

Alex Isenstadt contributed to this report.
