California students will have to take ethnic studies to get a diploma

SACRAMENTO — California will require students to complete an ethnic studies course to graduate from high school under a bill Gov. Gavin Newsom signed Friday, and it’s believed to be the first state to mandate such coursework.

The new law comes after a year in which California leaders and activists focused more on racial justice following the May 2020 police killing of George Floyd in Minneapolis. It also comes as conservatives nationwide have taken issue with K-12 lessons on systemic racism and protested at school board meetings against “critical race theory.”

High school students won’t be required to take the courses for graduation until 2029, while schools will be required to offer ethnic studies courses starting in 2025, giving districts and education officials time to fully develop coursework. The curriculum has been subject to intense debate as some ethnic groups have raised concerns with how their history will be taught.

Newsom’s office on Friday pointed to research from Stanford University that shows ethnic studies “help expand educational opportunities in schools, teach students about the diverse communities that comprise California, and boost academic engagement and attainment.”

The state took several years to develop a model curriculum for ethnic studies and drew criticism from the Legislative Jewish Caucus, which said the first draft omitted their full history. Schools will still be able to locally develop their own plan under Assembly Bill 101.

The bill asks districts to consider the “lengthy, thorough, deliberative and inclusive process” the State Board of Education took on to create a framework for the curriculum but allows schools to develop their own plan if approved by a local school board subject to public hearings.

The state’s ethnic studies framework, approved in March, promotes “a social consciousness” and will address “institutionalized systems of advantage” and forms of bigotry including anti-Blackness, xenophobia and anti-Semitism.

The bill’s author, Assemblymember Jose Medina (D-Riverside), has repeatedly pushed ethnic studies legislation to no avail. Newsom vetoed a similar bill last year, saying that while he agreed with the mission, he had concerns that the curriculum remained “insufficiently balanced” after concerns from Jewish and Arab American organizations.

Former Gov. Jerry Brown also vetoed an attempt in 2018, saying that while he valued ethnic studies, schools can already offer it on their own without a mandate.

The lengthy delay in implementation reflects the potential logistical and political challenges in developing the coursework and mandating it for graduation. The bill “provides a number of safeguards to ensure that courses will be free from bias or bigotry and appropriate for all students,” Newsom officials said in a statement.

“I want to acknowledge the countless young people, high school and college students, teachers and professors, who have organized, demonstrated, boycotted classes, and gone on hunger strikes to demand a more equitable and inclusive educational system,” Medina said in a statement. “The signing of AB 101 today is one step in the long struggle for equal education for all students.”

More Americans know basic civics, due to hyper-political media diets

New data finds that Americans have a much better understanding of the three branches of government than ever before, likely due to the massive increase of politics in our media diets.

Why it matters: “This knowledge appears to have been purchased at a real cost,” said Kathleen Hall Jamieson, director of the Annenberg Public Policy Center of the University of Pennsylvania. “It was a contentious year in which the branches of government were stress-tested.”


Details: An annual civics study conducted by researchers at the Annenberg Public Policy Center finds that a more polarized society knows more about the basics of American government, and much more about the First Amendment.

  • In 2021, 56% of Americans were able to name all three branches of government, up from 51% in 2020 and 33% in 2006.
  • About one-third of respondents say they know how long the term of office for members of Congress, both in the House and Senate.

Between the lines: Broadly speaking, Americans are much more aware of the protections guaranteed by the First Amendment, and particularly free speech.

  • More than half of respondents can name at least three of the freedoms guaranteed by the First Amendment. In 2016, most Americans could only name one.
  • In total, nearly three-fourths (74%) of all Americans were able to name freedom of speech as a right, followed by freedom of religion (56%) and freedom of the press (50%).

Yes, but: A greater understanding of issues like freedom of speech is likely the result of an increasingly polarized debate in society over censorship and media bias, which has muddled some of the facts around the issue.

  • To that end, more than half of Americans (61%) said incorrectly that the First Amendment requires Facebook to let all Americans express themselves freely on its platform.
  • Similarly, nearly half of Americans (49%) believe it’s accurate that arresting the Jan. 6 Capitol rioters violates their constitutional rights.

Bottom line: “It is a sad commentary on the public’s civic literacy that half of the public considers an effort to disrupt the certification of an election an exercise of a First Amendment right,” Jamieson said.

Public schools who want to institute mask mandate rules can’t be denied federal funds, even if their state governments try to pressure them out of mask mandates, Education Secretary Miguel Cardona said.

The Florida state government threatened to withhold funds for schools in Broward and Alachua counties if they imposed mandatory mask rules. But the Biden administration has proposed using federal funds to make up the difference, with Cardona specifying Sunday that the schools “do not have to get the green light for [their] governor to use these funds.”

“We have to do everything in our power to keep them safe,” Cardona said on NBC’s “Meet the Press.“ “I spoke to the superintendents of those two communities and I let them know that we have their back. And yes, they can draw down on the funds that were promised to them so they can safely reopen schools.”

Cardona added that the administration is prepared to launch investigations into states barring masking rules through the Office for Civil Rights — a move the administration floated last week.

Two days into school year, 440 students in a Florida district are quarantined

Nearly 500 students in Palm Beach County, Fla. have been quarantined because of COVID-19 just two days into the school year, the district’s superintendent said Thursday.

Why it matters: Superintendent Michael Burke’s announcement comes as Florida Gov. Ron DeSantis has maintained his executive order banning school districts in the state from requiring the use of masks amidst criticism and lawsuits.


  • Burke said that 51 cases of COVID-19 are confirmed in the district. Of the cases, 37 are students and 14 are employees.
  • While Palm Beach County public schools have now made masks mandatory for all students and staff, 6,394 of the roughly 167,000 students in the district have opted out of wearing them.

What they’re saying: “The governor’s got to take responsibility for establishing the ground rules we’re operating under,” Burke said. “And this ability for families to opt out is leading to more cases, which is ultimately going to send more kids home and deprive them of that traditional classroom experience.”

  • “We can’t completely mitigate the risk, but I think if we could mandate the face coverings, have our kids in the classroom, that would be the best shot,” he added.

The big picture: Florida has reported over 2.7 million COVID-19 cases so far and currently has an average seven-day positivity rate of between 20 and 25 percent, according to the Centers for Disease Control and Prevention.

  • Many children returning for in-person schooling this fall are not vaccinated, and children under 12 are not eligible for a vaccine.
  • The latest numbers from the American Academy of Pediatrics show nearly 94,000 cases of COVID among children.
  • DeSantis currently faces legal challenges over his order, with some districts mandating masks despite the ban.
