Cruz leads group of senators seeking to challenge Electoral College count

Nearly a quarter of Senate Republicans are officially preparing to challenge President-elect Joe Biden’s Electoral College win on Jan. 6, a stunning development that demonstrates just how far some in the GOP will go to align themselves with President Donald Trump’s flailing claims that the election was stolen from him.

Joining Sen. Josh Hawley (R-Mo.), eleven more Republican senators announced Saturday they will challenge Biden’s election victory next week when Congress gathers to certify the Electoral College vote. The movement is led by Sen. Ted Cruz (R-Texas), who circulated the idea among Senate Republicans of voting against certification of the election unless there’s an election audit.

The move is opposed by Senate Majority Leader Mitch McConnell (R-Ky.), though the GOP leadership is not whipping against the effort to prevent the certification of Biden as president.

In a statement on Saturday afternoon, 11 current and incoming GOP lawmakers said they intended to reject the electors from states where they claimed “unprecedented allegations of voter fraud, violations and lax enforcement of election law” arose until a 10-day audit of the election results in each state has been completed.

“Voter fraud has posed a persistent challenge in our elections, although its breadth and scope are disputed,” the group said. “By any measure, the allegations of fraud and irregularities in the 2020 election exceed any in our lifetimes.”

The group of Republicans insisted their effort wasn’t an attempt to thwart Biden or overturn the election, but rather aimed to protect “election integrity.” Likewise, Hawley said he was not trying to overturn the election.

“These are matters worthy of the Congress, and entrusted to us to defend,” the Saturday statement read. “And every one of us should act together to ensure that the election was lawfully conducted under the Constitution and to do everything we can to restore faith in our Democracy.”

The faction of GOP lawmakers includes Sens. Marsha Blackburn (Tenn.), Mike Braun (Ind.), Cruz (Texas), Steve Daines (Mont.), Ron Johnson (Wis.), John Kennedy (La.) and James Lankford (Okla.), as well as Sen.-elects Bill Hagerty (Tenn.), Cynthia Lummis (Wyo.), Roger Marshall (Kan.) and Tommy Tuberville (Ala.).

Lankford, Johnson and Kennedy are all up for reelection in 2022, and the vote will effectively become a wedge issue within the Republican Party. Republicans who vote against Trump and allow the certification of Biden’s election could find themselves with primary challenges. Trump has already endorsed a primary challenge to Senate Majority Whip John Thune (R-S.D.).

But many Republicans say the effort to challenge the election results doesn’t make a ton of sense.

“There’s good constitutional and other legal grounds to say: You had your day in court, 60 different lawsuits in state courts, you had a chance to appeal those to the Supreme Court, and as I read the law once a state certifies its electoral vote its conclusive. So that’s sort of the lay of the land,” said Sen. John Cornyn (R-Texas) in an interview on Friday.

But the 11 GOP senators said the courts should have examined the issue more closely: “Ideally, the courts would have heard evidence and resolved these claims of serious election fraud. Twice, the Supreme Court had the opportunity to do so; twice, the Court declined.”

Hawley pledged on Wednesday to challenge Biden’s win in Pennsylvania and other states when Congress convenes on Jan. 6 to certify the results of the 2020 election.

Pelosi to seat Republican in contested Iowa race

Speaker Nancy Pelosi confirmed Wednesday that she plans to seat the GOP winner of a contested race in Iowa on Jan. 3, despite a pending challenge from the Democratic contender in the razor-thin election.

Her decision avoids a brazen partisan showdown to kick off the 117th Congress, but it remains unclear if the GOP winner, Mariannette Miller-Meeks, will keep that seat for the entire two-year term, as Democrat Rita Hart continues to contest her six-vote loss, claiming not all legal ballots were properly counted.

In a controversial move, Hart has bypassed the Iowa courts and made her appeal contesting the results directly to the House. A House investigation is expected to take several months to make a recommendation on the true winner and then Congress can vote on who should hold the seat.

Pelosi made the announcement during a press conference Wednesday, when she succinctly replied “yes” when asked if she planned to seat Miller-Meeks before moving on to another question.

“Every vote counts and that’s why the Committee on House Administration is conducting a thorough and fair review of this election to make sure every vote was counted and counted as cast,” Pelosi’s spokesperson, Drew Hammill, elaborated in a statement following the press conference. “Pending the outcome of the Committee’s review and consistent with House practice, we intend to provisionally seat the Republican candidate on Sunday.”

The fate of Iowa’s second district — and who would be seated when Congress meets to begin the 117th Congress on Sunday — has remained an open question as lawmakers and campaign officials of both parties speculated what Pelosi might do. House Democrats could have also chosen to leave the seat open until the House panel completes its review.

But many Democrats were privately worried about the optics of not seating the certified winner of the seat as they continue to sharply criticize President Donald Trump’s efforts to overturn the presidential election results, despite Joe Biden’s overwhelming victory.

Refusing to seat Miller-Meeks, the certified winner of an election, would be extremely rare. It has only happened three times since 1933, according to congressional records.

Miller-Meeks was declared the winner by Iowa’s election officials in late November, but Hart has not conceded and is now asking the House Administration Committee to scrutinize the results and possibly overturn the state’s decision.

Any member of the House could object to Miller-Meeks being sworn in with the rest of the freshmen class on Jan. 3, but senior aides predicted that would be unlikely to happen after Pelosi made the decision to seat her.

Hart formally filed her challenge with the House last week under the Federal Contested Election Act. (Pelosi’s intent to seat Miller-Meeks will not directly affect Hart’s contest.)

In the coming weeks, the House Administration Committee is expected to create a panel to investigate her claims — potentially by conducting a recount — and then determine the victor of the seat.

In her complaint, Hart laid out a detailed explanation of why 22 ballots had been improperly rejected. Had these ballots been tallied, she said she would have been in the lead.

The current incumbent, Democratic Rep. Dave Loebsack, is retiring next month. Miller-Meeks, an ophthalmologist, has run four times for the southeast Iowa district. The district is a biennial swing-seat. Trump carried it in 2016 and 2020.

Trump turns on McConnell for calling Biden president-elect

President Donald Trump scolded Senate Majority Leader Mitch McConnell on Twitter early Wednesday morning for finally acknowledging that President-elect Joe Biden won the 2020 White House race.

The rebuke from the president came more than 14 hours after the Kentucky Republican delivered a speech on the Senate floor Tuesday in the aftermath of the Electoral College’s vote formalizing Biden’s victory.

“Our country has officially a president-elect and a vice president-elect,” McConnell said. “The Electoral College has spoken. So today, I want to congratulate President-elect Joe Biden.”

Trump shared a news report on McConnell’s remarks in a tweet posted shortly after midnight. In an accompanying message, he wrote: “Mitch, 75,000,000 VOTES, a record for a sitting President (by a lot). Too soon to give up. Republican Party must finally learn to fight. People are angry!”

McConnell further broke with Trump on Tuesday during a call with Republican senators, warning the lawmakers against objecting to the presidential election results when they are delivered to a joint session of Congress for certification early next year.

A spokesperson for McConnell declined to comment to POLITICO on Trump’s criticism.

In recent weeks, the president has trained his fire on Republican governors and other local officials he has deemed insufficiently supportive of his baseless claims of widespread voter fraud and scattershot legal bid to overturn the results of the election.

But his tweet Wednesday marked the first time Trump has so publicly turned on his party’s most senior Washington lawmaker for recognizing Biden as president-elect. McConnell had been reluctant to do so since the race had been officially called for Biden early last month, instead deferring to Trump’s ongoing effort to reverse the election’s outcome.

The Electoral College vote Monday was also an inflection point for many other Senate Republicans who until then refused to accept the reality that Trump had lost his campaign for a second term.

“I understand there are people who feel strongly about the outcome of this election,” Senate Majority Whip John Thune (R-S.D.), McConnell’s top deputy, told POLITICO. “But in the end, at some point you have to face the music. And I think that once the Electoral College settles the issue today, it’s time for everybody to move on.”

McConnell warns Senate Republicans against challenging election results

Senate Majority Leader Mitch McConnell warned Republican senators Tuesday during a private caucus call not to object to the election results on January 6, according to two sources familiar with the matter.

McConnell told his caucus that objecting to the results would force Republicans to take a “terrible vote” because they would need to vote it down and appear against President Donald Trump. Senate Majority Whip John Thune (R-S.D.) and Sen. Roy Blunt (R-Mo.) also echoed McConnell’s remarks.

Sen. Shelley Moore Capito (R-W.Va.) said that no one objected on the call to McConnell encouraging members to accept the election results.

“There wasn’t any pushback to it,” she said. “There’s wasn’t anyone saying: oh wait a minute. That didn’t occur.”

McConnell’s warning comes one day after the Electoral College officially voted for Joe Biden as the president-elect. The Kentucky Republican acknowledged for the first time that Biden will be the next president in his floor remarks Tuesday.

Several House Republicans, led by hard-line conservative Rep. Mo Brooks (R-Ala.), are still planning to challenge the election results on January 6, the date Congress will officially certify them. If a Republican senator joins the long-shot effort, however, it will force both chambers to take a vote on the election. But they have yet to get official buy-in from any GOP senators, though Sens. Ron Johnson (R-Wis.) and Rand Paul (R-Ky.) haven’t ruled it out.

Johnson, who is holding a Senate hearing Wednesday on election “irregularities,” recognized Biden as president-elect on Tuesday.

McConnell’s warning underscores how the last-ditch bid to overturn the election is putting the GOP in a bind. On the one hand, Republicans are facing pressure from Trump and his allies to support his attempt to remain in power. And party leaders want to keep the base energized ahead of a pair of critical Georgia runoff races on Jan. 5. that will determine control of the Senate.


But at the same time, McConnell — who is defending a tough Senate map in 2022 — needs to protect his members from taking a tough vote. If the Senate is forced to deliberate the election results, most GOP senators would be going on the record against a president who values fealty above all else. And it would be none other than Vice President Mike Pence presiding over the floor debate — a potentially awkward scenario as his boss continues to deny the reality of the election he lost.

McConnell on Tuesday’s call cited a 2005 objection from former Sen. Barbara Boxer (D-Calif.) after President George W. Bush’s reelection, which delayed the process by a few hours, according to several sources. The Kentucky Republican warned that he hoped no one, particularly in the class of 2022, thought that was a good idea.

Meanwhile, House Minority Leader Kevin McCarthy — a top Trump ally who has yet to recognize Biden as the president-elect — has dodged questions from reporters about whether he supports Brooks’ gambit. But McCarthy did say during a recent appearance on Fox Business Network that the courts are the proper venue to dispute election results.

“The president is right to go to the courts, have his legal challenges heard,” McCarthy added. “And he said he still has more opportunity to do that, so we’ll wade through and see what happens.”

On Friday, the Supreme Court rejected a longshot bid by Texas and other Republican-led states to overturn the election results. McCarthy had joined that effort.

Trump has yet to show any sign that he will concede. Instead, the president on Tuesday continued to reiterate false claims of voter fraud on Twitter.

The president is also publicly and privately leaning on his Hill allies to launch a last-ditch effort to reverse the election in Congress. He has praised Brooks on Twitter and retweeted a Breitbart news article Tuesday in which Brooks vows to continue fighting the Electoral College results in Congress.

Yet even if a GOP Senator gets on board, the effort is doomed to fail, given the makeup of the Democratic-led House and the increasing number of Senate Republicans who have recognized Biden as the president-elect. Still, it could become yet another Trump loyalty test in the GOP.

In January 2017, a handful of House Democrats took this precise procedural step before their efforts flamed out during a joint session of Congress presided over by Biden, then the outgoing vice president.

“It is over,” Biden said at the time, gaveling down Democrats as Republicans cheered.
