US Capitol attack committee issues subpoenas to 10 senior Trump officials

The House select committee investigating the January 6 insurrection at the US Capitol issued subpoenas on Tuesday to 10 more Trump administration officials, including former senior adviser Stephen Miller and press secretary Kayleigh McEnany, expanding its inquiry into Donald Trump’s involvement in circumstances surrounding the attack.

The subpoenas demanding documents and testimony are focused squarely on activities surrounding the White House and come a day after the select committee subpoenaed other top Trump lieutenants who aimed to undercut the results of the 2020 election while working from the Willard hotel in Washington.

Congress puts pressure on Biden to defend Taiwan

China’s military provocations toward Taiwan and President Joe Biden’s mixed messages are igniting a debate on Capitol Hill over whether to adopt a more aggressive official posture — including the possibility of preemptively authorizing Biden to use military force if Beijing invades the island nation.

The conversations, coupled with the White House’s efforts to walk back some of Biden’s apparent slips of the tongue, are fueling bipartisan efforts to ditch “strategic ambiguity,” the policy that has governed the U.S. posture toward the conflict for more than four decades. The strategic ambiguity doctrine, enshrined in the 1979 Taiwan Relations Act, stipulates that the U.S. remains purposely noncommittal about whether it would defend Taiwan from an attack or invasion by China.

But a push to proactively send Biden a war authorization could subvert ongoing efforts by Congress and the Biden administration to restrict presidential war powers. And undermining the status quo on Taiwan, both parties worry, could be seen by Beijing as a provocation, rather than a deterrent.

“This needs a very directed response from all of us that is properly worded,” said Sen. Jim Risch of Idaho, the top Republican on the Senate Foreign Relations Committee. “Because there’s a very delicate balance here, and we have maintained that delicate balance for many, many years. And it would be troublesome if we upset that.”

“I’m not interested in a cold war or a hot war,” said Rep. Jim McGovern (D-Mass.), a longtime proponent of reining in presidential war powers. “And I think that we ought to be focused on finding ways to prevent any kind of confrontation.”

Biden himself has been the source of some uncertainty about the U.S. position. In a recent CNN town hall, the president said “we have a commitment to” come to Taiwan’s defense if China attacks or invades the island nation — seemingly contradicting the strategic ambiguity policy.

White House officials quickly clarified that Biden was not announcing a policy change and that he was reiterating the U.S. commitment to Taiwan’s defense. But many Republicans — and, indeed, some Democrats — had hoped that he was, in fact, telegraphing a shift.

Rep. Elaine Luria (D-Va.), a retired Navy officer and the vice chair of the House Armed Services Committee, said in an interview that Congress should consider sending Biden a “very narrow and specific contingent authorization for the use of military force” to defend Taiwan. That action would effectively gut “strategic ambiguity” and allow the president to respond immediately to a Chinese attack or invasion without waiting for Congress to send him an authorization.

Luria added it could take weeks or months for Congress to consider and debate a war authorization if China were to attack. The U.S. would need to be ready to respond at a moment’s notice, she said, and that means being “less ambiguous” about “what our intentions are.”

“If we are going to intervene in a way that would limit the scope of conflict, prevent China from invading Taiwan, or deter them, then we could avoid a full-scale war,” she said.

Most members of Congress, Democrats and Republicans alike, are reluctant to give the president front-end authority to intervene militarily in the event of a Chinese invasion of Taiwan. Such an effort would also come at a time when bipartisan majorities in both chambers are moving to rein in, rather than ramp up, presidential war powers by taking outdated authorizations off the books.

“I am not a fan or advocate of giving war powers proactively to a president,” Senate Foreign Relations Chair Bob Menendez (D-N.J.) said in a brief interview. “If the president feels that that’s necessary, then he needs to come to Congress and then he can get an authorization for the use of military force.”

A senior administration official told POLITICO that the White House will “continue to engage with Congress on these important matters,” and that the Biden administration remains committed to the existing U.S. policy toward Taiwan.

At the same time, though, some lawmakers are expressing an openness to further bolstering Taiwan’s defensive capabilities — in ways that could muddle the strategic ambiguity policy.

“I do think that there are ways that we can enable Taiwan, whether that’s through foreign military sales, whether it is leverage with China, whatever we can find,” said Sen. Joni Ernst (R-Iowa), a combat veteran and a member of the Senate Armed Services Committee.

Earlier this week, Sen. Josh Hawley (R-Mo.), an Armed Services Committee member, introduced legislation that would send $3 billion each year to Taiwan for the purpose of boosting its military capabilities as a deterrent against Chinese aggression. He warned, however, that the U.S. should not suggest to Taipei that Washington would be standing by to head off an attack.

“It’s really important that we arm Taiwan and help them to defend themselves. China wants to gobble them up,” Hawley said in a brief interview. “But I think it’s also a mistake for [Taiwan] to say, ‘well, if something happens, the United States will just bail us out.’ They’re a long way away.”

Biden, a former senator and chair of the Foreign Relations Committee, has long been wary of drawing the U.S. into a war with China over Taiwan. In a May 2001 Washington Post op-ed, Biden criticized then-President George W. Bush for declaring that the U.S. has an obligation to defend Taiwan, similar to what the now-president said in the CNN town hall.

“No one expects world leaders to always stick the landing on their rhetoric,” said Sen. Todd Young (R-Ind.), a Foreign Relations Committee member. “And the strategic ambiguity is maintained when, after a media event, one clarifies one’s comments.”

At a news conference in Glasgow earlier this week, Biden said he was not worried about an armed conflict with China or even “something happening accidentally.”

“This is competition. It does not have to be conflict,” Biden said.

Indeed, the Biden administration has shown little interest in stepping back from strategic ambiguity, even as the president himself has hinted at a policy change in his off-the-cuff remarks. And some lawmakers are cautioning against statements and other actions that could upend the long-standing U.S. policy toward Taiwan, noting that the situation remains extraordinarily fragile.

“I think we have had a reasonably solid policy around Taiwan for going on 40 years now, and I don’t see a need to make that sort of an abrupt change to it,” said Rep. Adam Smith (D-Wash.), who chairs the House Armed Services Committee.

Gen. Mark Milley, the chair of the Joint Chiefs of Staff, said in an interview this week that the U.S. “absolutely” has the capability to defend Taiwan. While he doesn’t believe an invasion is likely in the near-term, “the Chinese are clearly and unambiguously building the capability to provide those options to the national leadership if they so choose at some point in the future,” he added.

That includes China’s recent test of a hypersonic missile, which some analysts have referred to as Beijing’s “Sputnik moment,” as well as its recent strike-group flyover which triggered Taiwan’s missile defense systems.

Others, like Adm. John Aquilino, head of U.S. Indo-Pacific Command, say that the possibility of a Chinese invasion is “much closer to us than most think,” adding that Beijing views a Taiwan takeover as its number-one priority.

Sen. Dan Sullivan (R-Alaska), an Armed Services Committee member and a colonel in the Marine Corps Reserves, noted that the U.S. has always reacted forcefully to actions by the Chinese that might portend a military conflict.

But, he said, “I think we need to think really hard about whether and to what degree we change the current posture.”

Senate Democrats unveil new income tax for billionaires

Senate Democrats on Wednesday released a billionaires’ tax proposal, designed to help support President Biden’s social spending and climate change legislation.

Why it matters: Sen. Ron Wyden (D-Ore.), chairman of the Senate Finance Committee, said the Billionaires Income Tax would raise “hundreds of billions of dollars” and would affect approximately 700 taxpayers who have more than $1 billion in assets or incomes of over $100 million a year.


Details: “Under today’s tax system, [billionaires] don’t have to pay capital-gains taxes unless they sell their assets, and they can borrow against that wealth to finance their lifestyles,” the Wall Street Journal writes.

  • The new plan would require billionaires to give the IRS a detailed account of how much the assets they own gained or lost each year.
  • It will ensurethe wealthiest people in the country pay their fair share toward historic investments in child care, paid leave, and addressing the climate crisis,” said Wyden, who released the proposal.

The big picture: The unveiling of the plan comes as Biden and congressional leaders race to finish — and figure out how to pay for — their nearly $2 trillion social spending and climate package.

Facebook is being deceitful, Sen. Blumenthal says

Sen. Richard Blumenthal on Sunday tore into Facebook, calling the company’s stated attitudes on regulation a sham.

Speaking on “Reliable Sources” on CNN, Blumenthal (D-Conn.) said, “What we are hearing from Facebook is platitudes and bromides. When it says it wants regulation, at the same time it is fighting that regulation tooth and nail, day and night, with armies of lawyers, millions of dollars in lobbying. And so, I must say, Facebook saying it wants regulation is the height of disingenuousness.“

Blumenthal’s remarks come after the recent revelations by Facebook whistleblower Frances Haugen, as well as widespread reporting about a range of issues with Facebook, including the worldwide proliferation of hate speech on the platform.

“The thing I saw at Facebook over and over again was that there were conflicts of interest between what was good for the public and what was good for Facebook,” Haugen said on CBS earlier this month. Blumenthal said he expected other “disgusted” Facebook whistleblowers to step forward.

“What we are seeing here is a building drumbeat for accountability,” Blumenthal told host Brian Stelter. “A movement for reform that will require disclosure of the powerful algorithms that drive destructive content to children and others, the hate speech in foreign countries, but also the anger and depression that is amplified by those algorithms as it leads children down rabbit holes.”

Blumenthal again called for Facebook CEO Mark Zuckerberg to follow Haugen and testify on Capitol Hill, and he also sought the full disclosure of internal files on Facebook‘s practices.

He told Stelter: “I wish Mark Zuckerberg would stand up to his responsibility. You know, he controls that company in a way few other single individuals do in corporate America, and he should be held accountable.”

House votes to hold Bannon in contempt of Congress

The House of Representatives voted 229-202 on Thursday to hold former Trump strategist Steve Bannon in contempt of Congress for refusing to comply with a subpoena from the Jan. 6 select committee.

Why it matters: The Justice Department will now consider bringing criminal charges against Bannon, marking a significant escalation in the Jan. 6 committee’s efforts to enforce subpoenas against Trump allies who refuse to cooperate.


Between the lines: If the vote demonstrated Democrats’ united front in using any means necessary to uncover facts about Trump’s role in Jan. 6, it also showed similar unity among Republicans for opposing the investigation.

  • A total of 9 Republicans, including Reps. Liz Cheney (R-Wyo.) and Adam Kinzinger (R-Ill.) — the two Republicans on the Jan. 6 committee — voted in favor of the resolution.
  • The others are Nancy Mace (R-S.C.), Peter Meijer (R-Mich.),  Anthony Gonzalez (R-Oh.), Fred Upton (R-Mich.), John Katko (R-N.Y.), Brian Fitzpatrick (R-Pa.) and Jaime Herrera Beutler (R-Wash.).
  • Of the Republicans who voted for the resolution, all but two, Fitzpatrick and Mace, voted for Trump’s impeachment in January.
  • Rep. Greg Pence (R-Ind.), whose brother Mike Pence was one of the high-profile targets of the Jan. 6 attack, was the only Republican who didn’t vote. “Congressman Pence has a family medical emergency he is attending to, however he would have voted no,” a Pence spokesperson said.
  • House Republican leadership whipped against the bill, telling members the subpoenas go beyond congressional authority and that the select committee “does not get to step into the shoes of law enforcement.”

The big picture: Bannon is just one piece of a far broader investigation into the attack.

  • The committee has subpoenaed three other former Trump aides, including former Chief of Staff Mark Meadows, and nearly a dozen organizers of a rally that preceded the attack.
  • Rep. Bennie Thompson (D-Miss.), the chair of the committee, said Wednesday Bannon is the only person subpoenaed by the panel who has “totally ignored the process.”
  • The committee has also sent document requests to government agencies, as well as social media and telecom companies, to piece together a comprehensive report on the attack.

What to watch: There has not been a successful prosecution under the criminal contempt statute since the Reagan administration. Assuming DOJ does bring charges, experts say it could take months, or even years, for Bannon to be convicted.

Jan. 6 investigators move to hold Bannon in contempt

The head of the House panel investigating Jan. 6 announced Thursday that he has scheduled a vote to hold former Trump adviser Steve Bannon in contempt of Congress.

On Tuesday, the select committee will vote on a report making the case that Bannon is in criminal contempt of Congress, according to Chair Bennie Thompson. That document will include language of a contempt resolution that could come to the House floor.

“The Select Committee will use every tool at its disposal to get the information it seeks, and witnesses who try to stonewall the Select Committee will not succeed,” Thompson said in a statement.

It will also detail the committee’s efforts to secure Bannon’s cooperation with its subpoena and his refusal to cooperate with the probe.

Investigators announced subpoenas of Bannon and three other former Trump administration aides on Sept. 23. Trump last week told all four men to stiff-arm the committee, as POLITICO first reported, but the committee has said two of those ex-aides, Kash Patel and Mark Meadows, are engaging with investigators. Bannon’s lawyer, however, has told the committee he will not comply with the subpoena.

Forcing him to comply will be a major test for the committee, signaling to numerous other witnesses just how much pressure investigators will exert to secure cooperation.

The outcome of the committee’s vote on holding Bannon in contempt is all but a foregone conclusion, as members have indicated for weeks that they would likely deploy criminal contempt against recalcitrant witnesses. If the panel approves holding him in contempt, the committee would send the resolution to the House floor for another vote.

If the full House, slated to reconvene next week, votes to hold Bannon in contempt — which is also all but certain, as Democrats have a slim majority — then the matter will be referred to the U.S. Attorney for Washington D.C. for criminal prosecution.

It’s unclear whether the Justice Department would move quickly following House action. Attorney General Merrick Garland has not indicated how he will handle such referrals, though he’s slated to testify to the House Judiciary Committee next week and is likely to be pressed on the matter.

If the Justice Department prosecutes Bannon and secures his conviction, he would face up to a year in prison and up to $100,000 in fines. He has the option to appeal, and the courts would determine whether to delay penalties during the appeals process.

Despite the tricky and unpredictable process, committee members say they hope the threat of criminal charges pressures witnesses to cooperate, rather than go through a costly and onerous legal process. Those threats have worked to compel cooperation in previous congressional inquiries, and witnesses rarely attempt to see the entire criminal proceedings through.

But the Jan 6 committee also faces a tight deadline, as it seeks to compile a full report on the attack by the spring.
